Can changes in gender affect Golden Visas?

I know this is an unusual situation, but I am wondering if a spouse chooses to change his or her gender, will that affect Golden Visa status? What may happen if a male-female relationship becomes a female-female relationship after that point? Does Greece consider those kinds of relationships as valid?

It can be recognized in Greece, but there is no need to do so, so there will be no change.

A change of identity could have an impact, yes. Depends also if the validity of the wedding is jeopardized in the country it initially took place in. A Golden Visa is granted to spouses when the marriage is valid and legal in the country in which it took place.

According to the Greek immigration law, family members of a property owner granted Golden Visa benefits are considered. Following a recent amendment to Greek law, consider the other spouse or partner with whom a third-country national has a cohabitation agreement in Greece. Also, in general, when a person changes his/her gender, the rights of the person are legal and valid. But if you have already the Golden Visa, as the spouse of the investor, the change of identity may have an impact on your resident permit, taking into consideration how your home country’s legal system handles the issue regarding the validity of the existing marriage. Following the above, you have to examine all the above parameters with a lawyer’s advice in order to face it effectively.

By law, Greece recognizes the reconciliation agreement and marriages between individuals of the same sex.

According to the pertinent provisions of the Greek law, as recently amended, the spouse or the partner with whom the investor has signed a civil partnership agreement in Greece are included in the family members whom the investor can bring with him/her in Greece. Thus, these persons are eligible for a Golden Visa. In Greece, the marriage between two individuals of the same gender is not allowed. However, the civil partnership agreement signed between two persons of the same gender is totally legal in Greece since 2015. Subsequently, even after the change of gender by the investor or his/her partner, there is the possibility of signing a civil partnership agreement in Greece that will enable the investor’s partner to legally acquire the Greek Golden Visa.
