Can we get a Portuguese D6 and permanent residency through marriage?

My girlfriend is an Italian and Agrentinean citizen. She is also a permanent resident in Portugal. She is a tax resident in Portual and has permanent residency. We are going to get married and file for the D6 visa. I have a couple of problems, and I am unable to get a straight answer from the lawyers I have consulted. I would really appreciate it if anyone could help me with my issue. We are going to get married in Pakistan online. Pakistan does recognize online marriage. I know Portugal and Italy have problems with online marriages. But if the marriage is registered in Pakistan they only need computerized, translated and legalized marriage certificate for IAMA. Once married, I'll register the marriage in the National Database and get a marriage certificate. When I explained the situation to a lawyer in Lisbon, she told me that I had to register the marriage at the Italian consulate and get an Italian marriage certificate. I don't understand why I need to register my marriage with the Italian consulate when my future wife already holds Permanent Residency in Portugal. I should be able to apply for family reunification with her being a permanent resident in Portugal.

    I can confirm that, under Portuguese law, you can apply for a D6 visa for family reunification, based on your future spouse’s permanent residency status in Portugal. Her Italian or Argentine nationality is not the deciding factor in this case. What matters is that she holds a valid permanent residence permit and is legally living in Portugal, which makes you eligible to apply as her spouse under the family reunification regime governed by AIMA. Regarding marriage, Portugal generally does not recognize online marriages unless they are officially registered and recognized by the country in which they took place. Since Pakistan does recognize online marriages, and if yours is fully registered with the authorities there, with a computerized NADRA marriage certificate, and the document is translated and properly legalized, it should be accepted by the Portuguese authorities. Please keep in mind that the marriage certificate must be translated into Portuguese by a certified translator. It must also be legalized either through an apostille in Pakistan. As for registering the marriage with the Italian consulate — this is not necessary for the D6 visa process, as you are applying through your spouse’s Portuguese residency, not her EU citizenship. That advice would only apply if you were planning to apply under EU Law, which is not the case here, given that you’ll apply through her residency in Portugal.
