To be eligible for the E-2 visa, you must be a Portuguese citizen, carry a Portuguese passport and have invested or be in the process of actively investing in a business in the United States, which must have the ability to generate profits and create jobs for American workers. If eligible, you must make the investment and fill out the Online Nonimmigrant Visa Application (Form DS-160) through the U.S. Department of State's Consular Electronic Application Center (CEAC). Then, schedule a visa interview at the U.S. Embassy or Consulate in Portugal. After the interview, the US Embassy or Consulate will review your application and conduct a background check. If approved, you will receive an E-2 visa stamp in your passport and can travel to the United States.

The E-2 visa is a renewable nonimmigrant investor visa. To qualify for the E-2 visa, the investor must accomplish some requirements, such as holding a passport from an E-2 country, investing a substantial amount of capital in a U.S. business, and owning at least 50% of that business. E-2 is only granted to nationals of countries with investment treaties with the USA. Currently, about 90 countries have this agreement, including Portugal. The E-2 visa is available to Portuguese citizens and it applies to naturalized golden visa investors.
