How can I as a UK investor apply for Portuguese residency if I own a holiday home in Portugal?

I live in the UK but have a holiday home in Portugal. I would like to apply for residency in Portugal. Once granted, would it be possible for my husband to live with me by family renunciation? Would he have to declare he had a suspended sentence for careless driving, if the conviction is spent over 5 years ago?

Owning a house in Portugal is not in itself a basis for applying for a visa for legal residence in Portugal. It is necessary to understand what type of house you own in Portugal in order to see if it fits the parameters required for a Golden Visa. If you do not meet the requirements to apply for a Golden Visa, you need to apply for another one. It is necessary to analyze your situation first. Please note that with the acquisition of a residence visa, the holder automatically gains access to the possibility to reunite the family members. As for the criminal record, the rule regarding visas is that it is not possible to obtain a visa if you have been convicted of a crime punishable in Portugal, by a sentence involving deprivation of liberty of more than 1 year, even if the sentence has not been served, or the execution has been suspended. In this sense, it is necessary to understand what was the penalty applied to your husband first.

Since you live and work in the UK and, therefore, you have an income in that country, the simplest and fastest way for you to have a residence permit in Portugal would be to apply for a D7 Visa, using your holiday home as your permanent residence in Portugal. As a resident in Portugal, you are guaranteed the right to family regrouping. Therefore, your husband will be able to apply for a residence permit, provided his criminal record does not contain any imprisonment conviction.
