The Investor Visa subclass 188B takes about 25 to 40 months for processing. The exact processing time cannot be adjudged. The processing time varies from case to case because of the type of documents, verification process, number of applications, and the number of visas available in that year. Therefore, there is no way to shorten this time period, except to ensure that all required documents are submitted at the earliest to avoid delays.

Applications for all business visas are currently on hold until the new financial year starts and states and territories receive their new program year allocations. The first part of an application for a 188B visa is the application for state nomination. This normally takes a few weeks. Once your application is endorsed by a state or territory you can proceed with a visa application. There may be changes to the business migration program before July 2023, so it is too early to comment on processing times in the future. It will save time to start preparing your documents now and be ready to lodge an Expression of Interest into Skill Select as soon as the migration program in your preferred state or territory opens up. A registered migration agent will be able to inform you of any changes to the migration program which may affect your future plans.

With the recent Ministerial Direction No 100, there are no longer any priorities for any of the subclass 188 streams. The subclass 188 visa is now at the lowest priority of the 5 priority levels of processing for skilled visas (includes general skilled migration, employer sponsored/nominated, global talent, business and investment). The removal of priority processing for the subclass 188 was expected given the concerns raised by the new federal government in Australia about the program. We are expecting information on the direction of the program to be released in February 2023, to be implemented in July 2023. This will likely see major changes to the business and investment program, increasing requirements and possibly removing streams.
