How can I switch my current student visa to an Entrepreneur Stream visa in Australia?

    The Australian entrepreneur visa was a stream under the subclass 188 Business, Investment, and Innovation Program (BIIP). This program formally closed for new applications in June 2024 (although it effectively closed much earlier). There is currently no entrepreneur visa pathway for Australia. The new (from December 7th, 2024) National Innovation Visa will likely have some entrepreneur aspects considered under state/territory government nomination. This will be largely for the state and territory governments to determine, and we don't yet know what this criteria will be. It will require experience that demonstrates outstanding achievements and will likely require local agreements in the state or territory to be in place to support innovative activities and/or commercialisation of products or services. The various states and territories participating are you to publish their criteria. Do expect this to be released in the coming months. An alternative strategy, given you're already on a student visa, is to start a business in Australia and then use the business to sponsor you for a skills-in-demand work visa. After 2 years working in the business, you can apply for permanent residence under the temporary residence transition scheme. Do note that while you can "self sponsor" (the business you own and manage can sponsor you as an employee provided it is not a sole trader), you will need to demonstrate that the position and need are genuine to prove to the department you are not doing this for the primary purpose of providing yourself with a visa to remain in Australia. These matters are obviously complex, so do talk to a registered migration agent for advice.

    All streams including the Entrepreneur Stream of subclass188 Business Innovation and Investment visas are closed as on 31 July2024.  However some states such as Queenslandand Australian Capital Territory provide a pathway for migrants including student visa holders who are currently living in and operating a smallbusiness in regional Queensland or Australian Capital Territory with aninvestment of over $100,000, and meet their requirements, which can lead to subclass 491 visa.  You need to contact the regional governmentsto get more details on the same.
