What would be the impact of Australia’s new investment visa rules on foreign investors already in the country?

I’m a Chinese investor who recently arrived in Australia under the Significant Business History visa program. How would the new changes to Australia’s investment visa rules affect investors like me who arrived in the country under old visa schemes? Would my existing threshold of required investments change to a higher amount?

If you have been granted a 132 Business Talent visa in the Significant Business History stream you already hold permanent residence and the changes to the business migration program will not affect you.

Historically, when changes are introduced, applications made at earlier dates do not get impacted. As you already hold you a permanent visa under the subclass 132 Significant Business History, you will not be impacted by the proposed changes to be introduced in 2021. I think, it's likely the cancellation provisions that apply for the first 3 years under the subclass 132 will remain, but you can check back with us after July 2021 to see if there are any changes in this area.

I believe the impact to your visa is minimal. The exact requirements of your PR will likely be more accessible when you become eligible for the permanent residence visa applications. However, the Australian Department of Home Affairs has made a statement that they will keep the scheme the same as it were since 2012 with higher entry requirements for new temporary residence visa applicants but the same purpose and method in mind.
